Pursuant to the Colorado Privacy Act (“CPA”), Colorado residents have the right to be informed about the data we collect about them. This Privacy Notice applies solely to natural persons who are Colorado residents, as defined in the CPA. Please note that this Privacy Notice does not apply to Colorado residents who are acting as employees or job applicants.
If you are a Colorado resident, you have the following rights:
- You have the right to know and see what Personal Information we have collected about you in a usable format.
- You have the right to request that we correct inaccurate Personal Information.
- You have the right to request we delete the Personal Information we have collected about you, subject to applicable legal exceptions.
- You have the right to “opt out” of targeted advertising and the sale of your Personal Information (as defined under CO Law).
Sensitive Data
As described in this Privacy Notice, DemandFactor, Inc., may process certain personal information that is considered “Sensitive Data.” Processing of sensitive data only occurs when you knowingly take affirmative action to provide such information to us for processing
Sensitive personal data means: (A) data revealing racial or ethnic origin, religious beliefs, mental or physical health condition or diagnosis, sex life, sexual orientation or citizenship or immigration status, (B) the processing of genetic or biometric data for the purpose of uniquely identifying an individual, (C) personal data collected from a known child with parental or guardian authorization and consent, or (D) precise geolocation data. To the extent that we collect sensitive data, you have the right to consent or revoke your consent to the collection and/or use of such data.

DemandFactor, Inc., will endeavor to respond to all requests within 30 days. To respond to your requests to access, obtain a copy of, correct or delete your personal data, we will need to verify your identity and/or authority to make such requests and access, receive, modify or delete such personal data.
When you submit a request, we will take steps to verify your identity. You are not required to create an account with us to submit a request. We may ask you to provide us with information about yourself in order to verify your identity. We will only use the personal information you provide in connection with identity verification to verify the requestor’s identity or authority to make the request and whenever feasible, we will attempt to match the information you provide with information we may already have about you.
Decisions made by DemandFactor, Inc., pursuant to any above request may be appealed to DemandFactor, Inc.’s Privacy Officer by submitting a request to review the decision by mail at Attention Privacy Officer, 1110 Brickell Avenue, Suite 400, Miami, FL 33131 or by electronic mail at [email protected]. Within 45 days of your submission, we will inform you in writing of the appeal decision with an explanation of the reason for the decision. Agent Authorization
You may designate an authorized agent to request any of the above rights on your behalf. You may make such a designation by providing the agent with written permission, signed by you, to act on your behalf. Your agent may contact us as set forth in this Notice. Even if you choose to use an agent, as permitted by law, we may require you to confirm you have authorized the agent to act on your behalf or require you to verify your own identity.
